Welcome to EmuTherapy.com (the "Site"), owned and operated by ACA Management, LLC dba Emu Therapy (Company). The Company offers the Site and Other Collateral Materials conditioned upon your acceptance of these Terms of Use (these "Terms"), and your continued use constitutes your agreement to these Terms. If you do not wish to be bound by these Terms, do not use the Site or the Other Collateral Materials.

 

Your License to Access the Website and Other Collateral Materials

Emu Therapy content, information, software, designs, and data are protected by intellectual property and other laws. You must comply with these and any other applicable laws.

Unless indicated to the contrary, you may use the Site and Other Collateral Materials only for personal, non-commercial use, or in connection with your authorized purchase or sale of our products. In connection with these uses, you may access, copy, download and print the content and materials provided that you do not modify the content or delete any copyright or other notice.

We reserve all rights in the content and materials that we do not specifically grant in these Terms.

 

Registration and Access Restrictions

There are certain features of the site that require you to create an account. If you choose to utilize these features you agree to provide true, accurate, current and complete information about yourself and update this information to keep it true, accurate, current and complete.

You must maintain the confidentiality of any access codes registered with us and notify the Company immediately of any unauthorized use of your credentials or any other breach of security. Even if you notify us, you will be responsible for any activities that occur using your access codes, including any charges resulting from the use of your account.

 

Submissions

When you submit or transmit audio, video, text, or other materials you grant to the Company a nonexclusive, royalty-free, perpetual, worldwide, irrevocable and fully sub-licensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute and display such content throughout the world in any media, whether now known or hereafter invented, including for commercial or marketing purposes, and to use your name or likeness alone or in connection with such uses.

Except as provided in our Privacy Policy, we do not guarantee that submissions will be private, even if the submission is in a password-protected area. Accordingly, you should not provide submissions that you want protected from disclosure.

By providing submissions, you represent, warrant and covenant that you own those submissions or otherwise have the right to grant to us the rights described in this section. You further represent, warrant and covenant that the submissions:

- will be accurate and will comply with these Terms;

- will not cause injury to any person or entity, including as used by us in accordance with these Terms;

- will not include medical or other professional advice;

- will not be false, fraudulent, libelous, defamatory, sexually explicit, obscene, threatening, invasive of privacy or publicity rights, abusive, illegal or otherwise objectionable;

- will not constitute or encourage a criminal offense, violate the rights of any party, including intellectual property rights, or otherwise give rise to liability or violate any law;

- will not contain software viruses, political campaigning, chain letters, mass mailings, or any form of "spam"; and

- will not contain advertising or other commercial material, except with our prior written consent.

We may refuse or remove a submission without notice for any reason. The Company nor our employees or agents will be liable for any loss or damage resulting from any submissions.

 

Links to Third Party Sites

The Site may contain links to other sites that are not operated by Emu Therapy. These links are provided as a convenience to you. However, we do not represent that we have endorsed or evaluated the information on those other sites. Your relationship with the operators of these third-party sites is governed by the terms and conditions, security and privacy policy, if any, of those sites, and not by these Terms. Therefore, you should review those documents before using the third-party services.

 

Mobile Terms of Use

The Emu Therapy mobile message service (the "Service") is operated by Emu Therapy (“Emu Therapy”, “we”,  “us”, or "Company"). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Emu Therapy’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Emu Therapy through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Emu Therapy. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to +18559147683 or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Emu Therapy mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

Jurisdiction and Venue

The laws of the State of Oklahoma govern these Terms.

 

Changes to These Terms of Use

We reserve the right to change these Terms at any time. We will make a reasonable effort to maintain an accurate revision date shown at the top of these Terms of Use for quick reference.
